The BEAUMANOIR group controlled by the holding company C.C.V Beaumanoir, a company governed by French law, is an international group specialized in the distribution of ready-to-wear products and incidentally of personal equipment. The terms referred to in this policy (hereinafter referred to as “the Policy ) are generic and are defined on the basis of the General Data Protection Regulation (hereinafter “the GDPR ) which applies to the French companies of the Beaumanoir Group Appendix A Policy (hereinafter referred to as “the BEAUMANOIR Groupwe ” or ” Nos “).

1. Introduction, objectives and scope

The Policy aims to inform Candidates of the processing of their personal data within the BEAUMANOIR Group and how the BEAUMANOIR Group complies with the GDPR requirements.

The Policy may be amended or adjusted at any time in the event of legal, case law or in the light of the decisions and recommendations of the CNIL and its uses.

1.1. Scope of the Policy

The Policy is intended to apply to any natural person outside the BEAUMANOIR Group who contacts a French entity of the BEAUMANOIR Group, or is contacted by a French entity of the BEAUMANOIR Group with a view to presenting his candidacy for any position within an entity of the BEAUMANOIR Group, for a contract of employment or for any other similar contract, including for an apprenticeship contract or a professionalization contract, as well as for an internship (hereinafter referred to as “the ” Candidate(s)you ” or ” your “).

The processing of Candidates’ personal data may vary slightly from one entity in the Beaumanoir Group to another.

The Policy will be interpreted according to French law. Should a translation of the present be communicated to the Candidates, it is understood that only the French version would be authentic.

The current version of this Policy is available on the institutional site of the BEAUMANOIR Group (https://www.groupe-beaumanoir.com/).

1.2. The entities of the BEAUMANOIR Group, Processing Manager

If, on a daily basis, HR services and/or entities within the BEAUMANOIR Group process your personal data, from a legal point of view, the responsibility to ensure that the processing of such data is carried out in accordance with the applicable laws rests with the BEAUMANOIR Group entity from which you are applying.

Some of the processing activities mentioned in this document are carried out by the BEAUMANOIR Group entity with which you are applying. Other activities, such as the management of the CVthèque or the management of the email alert are mainly carried out in-house, where appropriate by one or more companies as subcontractor.

The exact distribution differs between entities and over time. We can confirm the type of treatment performed and the entity in charge of this treatment on request.

1.3. Definitions

The following terms are used in this Policy. These definitions are based on GDPR and are the standard definitions used by the BEAUMANOIR Group in general. However, the definitions of these terms may vary from country to country and you can contact the Data Protection Officer of the BEAUMANOIR Group (hereinafter referred to as “the Data Protection Officer”). Personal data (or “Data”) :Any information relating to an identified or identifiable natural person. An “identifiable person” is a natural person who can be identified, directly or indirectly, in particular by reference to an identifier, such as a name, identification number, location data, an online identifier, or to one or more elements specific to his or her physical, physiological, genetic, psychic, economic, cultural or social identity.
Purpose:The objective of processing Personal Data. As part of this Policy, the purposes of processing Personal Data are mentioned in paragraph 4.3.
Treatment Officer :BEAUMANOIR Group entity which, alone or jointly with others, determines the purposes and means of processing the Data, i.e. the objective and how to achieve it. With regard to the processing of Candidate Data, the Data Controller is the entity of the BEAUMANOIR Group seeking to recruit.
Subcontractor :Entity other than the Data Controller, who processes the data account, on instruction and under the authority of the Data Controller (are excluded the employees of the Data Controller). For example, companies providing IT services or advice to the Processing Manager and the recruitment firms with which the BEAUMANOIR Group works, which deal with Data on our behalf, but also an entity of the BEAUMANOIR Group that provides administrative assistance within the BEAUMANOIR Group and deals with Data on behalf of other legal entities of the BEAUMANOIR Group, are Subcontractors.
Treatment :Any operation or set of operations carried out or not using automated processes applied to Data, such as collection, recording, organization, structuring, preservation, adaptation or modification, extraction, consultation, use, communication by transmission, dissemination or any other form of provision, reconciliation or interconnection, limitation, erasure or destruction.

2. Important information on treatment

By providing your information to the BEAUMANOIR Group and its entities through your application for a position in the BEAUMANOIR Group, you acknowledge and understand our use of your Personal Data, as described in this Policy.

3. The Data we collect

As part of your recruitment, we need to collect and process your Data, whether it is provided by you or by a third party (for example, a recruitment firm through which the entity of the BEAUMANOIR Group from which you applied went to disseminate its job offer).

For the purpose of minimising the data, we shall only collect and use data relevant and necessary for processing. The Data you are asked for therefore have a direct and necessary link to the position for which you are applying.

We ask you to do not provide in your CV, information that is not strictly necessary for your application, and more broadly any sensitive data (racial or ethnic information, political, religious or philosophical opinions, trade union membership, health, sexual orientation). If you choose to transmit such information to us, it is submitted under your sole responsibility and on your own initiative.

Data that can be collected and processed are mainly:

In the absence of certain data required for the examination of the application file, the Processing Manager will not be able to process the applicant’s application.

The mandatory or optional nature of the Candidate’s answers (e.g. questions about leisure) and the possible consequences if the Candidate chooses not to answer are explained at the time of collecting your Data.

4. Our use of your Data

4.1. Justification for our use of your Data

When applying to the BEAUMANOIR Group, we ask you to provide the Data necessary to process your application. If you do not wish to provide us with this information, the entity of the BEAUMANOIR Group from which you are applying will not be able to process your application.

An explanation of the scope of the legal bases used to justify each type of treatment identified in subsection 4.3 of this Policy is available below.

Contract performance: When your Data is required to carry out pre-contractual measures as part of your hiring within the BEAUMANOIR Group.
Legitimate interests: When we use your Data for legitimate interests pursued by the BEAUMANOIR Group or by a third party, and these reasons prevail over any prejudice to the protection of your Data.
Consent: When your consent is required for the processing of your Data, for one or more specific purposes. You are free to withdraw this consent by contacting us as described in Section 10 of this Policy. However, if you wish to withdraw your consent, we may no longer be able to continue your recruitment.

4.2. Limitation of treatment impact

For each use of your Data, we will limit the impact on your privacy by appropriately minimizing our use of this Data, and by putting in place access and security devices to prevent unauthorized uses.

4.3. How we use your Data and how we justify every use of this Data

The processing of your Personal Data enables the Processing Manager to manage applications, including:

5. Sources of collection of your Personal Data

We may collect your Personal Data directly from you (via the contact form available on the BEAUMANOIR Group’s institutional website and/or through your application for an offer on the BEAUMANOIR Group’s institutional website) or through third parties, such as recruitment firms or job sites, with which the BEAUMANOIR Group works.

6. The recipients of your Personal Data

For the purposes of the processing described above, your Personal Data is intended for the BEAUMANOIR Group entity from which you apply. These Data are not communicated to third parties except to:

7. Storage and retention times of your Data

You are part of the BEAUMANOIR Group entity that hired you. Your Personal Data will then be retained for the retention periods provided for within the BEAUMANOIR Group Collaborators’ Privacy Policy.

In case of a negative outcome of your application, i.e. if your application is not successful, neither for the position to be filled nor for any other position within the BEAUMANOIR Group, nor for future recruitment, your Data will be destroyed immediately.

We reserve the opportunity to keep your file, provided that you expressly confirm your agreement to keeping your application file.

In this case, if you confirm your agreement and do not request the destruction of your application file, then your Data will automatically be destroyed two (2) years after your last contact with the BEAUMANOIR Group. Only your express consent will allow for longer retention of your file.

8. Security and confidentiality of your Data

We may keep your Personal Data in electronic and/or paper format.

8.1. Security of Personal Data retained in hard copy

When your Data is retained in paper format, it will be retained for the durations specified in Sections 4.3 and 7 of this Policy. After the defined period, the Data will then be destroyed in accordance with Section 7.

8.2. Security of Personal Data retained in electronic format

When your data is stored in electronic format, it is stored primarily on the databases of the relevant HR department. The access and use of these databases are limited to the personnel authorized by the BEAUMANOIR Group and can only be made in accordance with our security rules of the BEAUMANOIR Group information system.

Authorized personnel need access to your Data to fulfill their obligations. They are authorized members of HR and IT departments.

8.3. Actions undertaken to ensure the security of your Personal Data

The BEAUMANOIR Group takes measures to protect your Personal Data from loss and theft, and against access, disclosure, copying, use, unauthorized modification, regardless of the format in which it is stored, and uses technical and organisational security mechanisms to provide appropriate protection.

9. Candidate’s rights

You have several rights to your Personal Data:

Right of access and copying:You can obtain access to and copy of any Personal Data pertaining to you and held by the BEAUMANOIR Group, usually within one month of your request. Furthermore, you must not exercise your right of access and copying in an abusive manner, i.e. carried out on a regular basis for the sole purpose of destabilizing the BEAUMANOIR Group.
Right to rectification and updating:You may request that inaccurate or incomplete Personal Data be corrected or completed.
Right to erasure (“right to be forgotten”) :You may request that your Personal Data be deleted in certain circumstances, including if this Personal Data is no longer required for processing.
Withdrawal of consent :You can withdraw your consent to any processing of your Personal Data, and obtain termination of processing where this is justified by this legal basis.
Right to limitation of treatment :You may request limitation of the processing of your Data for one of the reasons referred to in Article 18 of the GDPR, e.g.:· When you challenge the accuracy of your Personal Data (e.g. in the case of an error related to your marital status), for a period of time allowing the Data Controller to verify the accuracy of this Data.
Right to portability data:You may request that your Personal Data be transmitted to you or transmitted to a third party in structured and commonly used computer format.
Right of opposition:You may object to any processing of your Personal Data at any time for reasons relating to your particular situation; to a processing of your Data whose legal basis is the legitimate interest pursued by the BEAUMANOIR Group. If such a right of opposition is exercised, the BEAUMANOIR Group will no longer process the Data concerned. Given that the exercise of the right of opposition may compromise the proper follow-up of your application by the BEAUMANOIR Group.
Right to define guidelines on the fate of your data in case of death:You can set guidelines for the retention, erasure and disclosure of your personal data after your death. You can modify or revoke your instructions at any time.
Right to complain to CNIL:If you consider that the processing of your Personal Data constitutes a violation of the applicable regulations, or that you are not satisfied with the answer given by the Controller to your request for exercise of the right, you may lodge a complaint with the CNIL, directly on its website (https://www.cnil.fr), or by post at the following address: National Commission for Information and Freedoms

If the Controller has a reasonable doubt about your identity when you apply, we may ask for proof of identity. Please note that some of your rights may be limited under legal exceptions. In this case, you will not be able to invoke these rights.
